Scarcity of Pro Bono Lawyers Hindering Children’s Access to Justice in Kenya

Kisii — At Kisii University, the lack of pro bono lawyers has been identified as a major obstacle to children’s access to justice in Kenya. This issue was highlighted by Florence Momanyi, a Commissioner at the National Council for Administration of Justice, during a press interview at the launch of the Wakili Wa Watoto Club at the university’s School of Law.

According to Kenya News Agency, the shortfall of pro bono lawyers significantly delays justice for minors, with some cases dragging on for over six months. She emphasized that such prolonged legal processes could continue even after the children involved turn 18, effectively denying them timely justice. This situation underscores a critical gap in the legal system where vulnerable minors are left without adequate legal representation.

Peter Shikuku, Chief Executive Officer at The Lake Region Development Programme, discussed their partnership with Kisii University. This collaboration aims to utilize law students in reaching out to grassroots communities and increasing awareness about children’s rights. Shikuku encouraged members of the newly formed Wakili Wa Watoto Club to actively advocate for children’s rights, highlighting the frequent exploitation and neglect of these rights in society.

Eunice Kilunda, the Child Protection and Advocacy Manager for Child Fund Kenya, charged the Wakili Wa Watoto Club with the task of educating the public about the Children’s Act 2022. This act is a vital piece of legislation aimed at protecting the rights and welfare of children in Kenya.

Joseph Mirieri, the Chairperson of the Wakili Wa Watoto Club, committed to creating an informed environment for minors joining the institution. He pledged that the club would focus on educating and safeguarding the rights of these young individuals.

This initiative at Kisii University marks the second chapter of the Wakili Wa Watoto Club, following an earlier launch at Strathmore University. The primary goal of these clubs is to bring together law students with an interest in child matters to actively champion children’s rights and address the pressing need for legal support in child justice cases.
