Law Society of Kenya Urges Embrace of Alternative Dispute Resolution in Loitoktok

Loitoktok - The Law Society of Kenya (LSK), South Eastern Bar, is calling on residents to consider utilizing alternative dispute resolution (ADR) as an official way to seek justice outside of traditional courtroom settings. Advocating for the use of ADR, the society emphasized its ability to expedite legal proceedings and foster societal cohesion.

According to a new release by Kenya News Agency, Raphael Marete, an advocate and a member of the society based in Loitoktok, spoke on the issue outside the Loitoktok Law Court premises during the commencement of LSK service week, which runs from October 23 to October 27. Marete explained that ADR is legally recognized, and the resolutions reached through this method can be submitted to court for adoption and final judgment. He highlighted the benefits of ADR, including the speedier delivery of justice and the ability to defuse potential revenge motives, contributing to societal peace.

However, Marete clarified that ADR is not a universal solution. Cases involving defilement or those that involve children are not eligible for ADR. On the other hand, debt-related disputes and assault cases could be resolved outside the court.

During LSK service week, Marete called upon residents to avail themselves of free legal services and advice. Discussing prevalent local issues, he pointed out the high incidence of defilement cases in Loitoktok, attributing it to the culture of early marriage within the Maasai community. Marete mentioned that LSK has taken steps to educate the community on the illegality of this practice and offers pro bono legal services for accused persons under the age of 18 involved in defilement cases.

In addition, Marete acknowledged the recent establishment of a Small Claims Court at the Loitoktok Law Court. Prior to this, individuals with minor claims had to incur the expense of hiring advocates, often making legal recourse impractical. With the new court, fees are more affordable, and in most cases, the hiring of an advocate is unnecessary.
