Burkina Faso Government Empowered to Legislate on Military Affairs by Decree

Ouagadougou: The Transitional Legislative Assembly (ALT) has granted the Burkina Faso government the authority to legislate by decree in matters of national defense for a period of one year. This measure is intended to enable rapid responses to pressing security needs without the delays associated with the usual parliamentary procedures.

According to Burkina Information Agency, the decision to permit decree-based legislation arises from the necessity for swift action in national defense, a requirement not easily met through the conventional legislative process. The aim is to ensure that the pace of parliamentary proceedings does not hinder the effectiveness of military operations currently in progress.

The legislative empowerment covers various aspects of military operations, including the organization of command, temporary personnel management, adjustments to disciplinary measures, and the establishment or reorganization of specific operational structures. Additionally, it seeks to enhance the deployment mechanisms of military forces.

The enabling act consists of four articles. The first article permits the government to take necessary measures by ordinance concerning national defense needs. The second article stipulates that this authorization will last for one year. The third article outlines the procedures for ratifying ordinances issued under this framework, while the fourth article addresses the enforcement order.

It is important to note that an ordinance, in this context, is an act issued by the Council of Ministers in areas typically reserved for legislation, made possible through an enabling act authorized by Parliament.
