The Congress of South African Trade Unions in the North West is worried and concerned about the abuse of power by some of the Magistrates in relation to farm area’s cases within the Hertzogville magistrate area.
Most of our poor farm workers and poor farming communities are disaantaged due to the conduct of some of magistrates, in particular those who are whites.
Poor farm workers, who are complainant or who are affected by the conduct of farmers and some of the magistrates and prosecutors reneges to deliver justice.
We have been observing the attitude of some of the prosecutors and magistrates when the accused are allegedly white farmers or other whites civilians and their cases are treated differently.
What is happening in those courts is an abuse of power and it must be corrected.
And that action must be taken against those who, use their power to exploit the poor.
What happened in the Hertzogville magistrate court during the case of a farmer, who killed three farm workers, was application of injustice to many.
We experienced a situation in which the white magistrate arrived at 13h00, later the prosecutor was to be collected at Welkom and postponed all cases at 15h00.
And we called this an abuse of power by magistrate and prosecutors .
In one court or two in Schweizerenek and Vryburg, the magistrate asked the accused, who killed farm workers and how much they can afford for bail and the alleged killer was released.
We call our justice system to protect our poor citizen of this country, regardless of the colour of their skin and regardless how much they have in their bank accounts.
We call our Justice Minister to investigate the situation in those courts in the farms and rural areas in particular the Hertzogville court, and the magistrate and the prosecutor must account.
