South Africa: Muthambi in Defiance of Cabinet and the President’s Position On Tsotsi Number 2, Hlaudi Motsoeneng
It would appear the Communications Minister Faith Muthambi is in defiance of Cabinet’s position on Tsotsi Number 2, Hlaudi Motsoeneng.
In a reply to a DA parliamentary question, President Jacob Zuma states:
I regularly meet with Ministers to discuss maters pertinent to their portfolios. Cabinet, which I chair and lead, discussed the SABC matter and pronounced itself strongly on what needs to be done to bring the entity on the right path. The Minister is a member of cabinet and is aware of the discussions and is bound by them as well.
Cabinet’s position as expressed by Minister Jeff Radebe on 30 September 2016 strongly condemned Mr Motsoeneng’s re-appointment at the SABC. He stated:
The decision to reappoint Mr Motsoeneng in a new position shows disrespect of a rule of law. Cabinet calls on the SABC Board to abide by the letter and spirit of the SCA ruling. Attempts to subvert the SCA ruling through legally suspect interpretations border on violating the constitutional principle of legality and challenge the constitutionally assigned judicial authority of our courts.
In endorsing and supporting Mr Motsoeneng’s appointment as Group Executive of Corporate affairs, it is quite clear that she is in defiance of Cabinet and the President’s position in this regard.
It would therefore follow that a Minister who defies the position of the Cabinet to which she belongs, must be reprimanded or dismissed.
